These Terms of Service (“Terms”) govern your use of the SKI SUPPLY website and your purchase of products from SKI SUPPLY. By accessing our website, placing an order, or otherwise using our services, you agree to these Terms.
Throughout these Terms, “we,” “us,” and “our” refer to SKI SUPPLY. “You” and “customer” refer to any person accessing our website or purchasing products from us.
These Terms apply together with our Return & Refund Policy, Shipping Policy, Privacy Policy, and any other policies displayed on our website.
1. ONLINE STORE TERMS
By using our website or placing an order, you represent that you have reached the age of majority in your province, state, country, or jurisdiction of residence, or that you have obtained any legally required consent to use our services.
You may not use our products or services for any unlawful or unauthorized purpose or violate any applicable laws through your use of our website.
We reserve the right to refuse service, cancel orders, restrict purchases, or limit quantities where reasonably necessary, including in cases of suspected fraud, unauthorized transactions, pricing errors, abuse, or violations of these Terms, subject to applicable law.
2. PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to display and describe our products accurately. However, product colours, appearance, packaging, measurements, and other characteristics may vary slightly from photographs or descriptions due to manufacturing variations, screen settings, supplier updates, or other factors.
Product images are provided for illustrative purposes. Minor differences that do not materially affect the product’s advertised characteristics do not necessarily constitute a defective or incorrect product, subject to applicable consumer-protection law.
We reserve the right to modify product descriptions, prices, availability, specifications, or other website information at any time, subject to applicable law.
3. THIRD-PARTY FULFILLMENT AND SUPPLIERS
SKI SUPPLY may use third-party suppliers, fulfillment providers, manufacturers, and shipping carriers to process and deliver orders.
As a result, products may be shipped directly from third-party fulfillment locations and may originate from different countries or warehouses.
Orders containing multiple products may arrive in separate packages and at different times. Separate shipments do not, by themselves, constitute a missing, incomplete, or defective order.
Our use of third-party suppliers does not limit any consumer rights that cannot legally be excluded.
4. MYSTERY BOXES
Certain products offered by SKI SUPPLY may be sold as mystery boxes or similar products where the specific items received are not selected by the customer.
By purchasing a mystery box, you acknowledge that the exact products, styles, colours, designs, or combinations included may vary within the description and eligibility criteria displayed on the applicable product page.
Customers are not entitled to a refund, return, exchange, credit, or replacement merely because they would have preferred a different eligible item, style, colour, or combination, except where required by applicable law.
Any stated number of items, guaranteed value, eligible product categories, exclusions, or other guarantees displayed on the mystery box product page will form part of the product description.
Receiving an eligible product that differs from another customer’s mystery box does not make the product defective or incorrect.
Mystery box products remain subject to our policies concerning defective, damaged, or incorrectly supplied products and any mandatory consumer rights.
5. PRICES AND PAYMENT
Prices are displayed in the currency indicated on our website or at checkout.
You agree to provide current, complete, and accurate billing and payment information when placing an order.
We reserve the right to correct genuine pricing, typographical, technical, or listing errors. Where permitted by applicable law, an order affected by an obvious pricing error may be cancelled and any amount already paid for the cancelled order will be refunded.
Prices, promotions, discounts, and product availability may change without notice.
6. ORDER ACCEPTANCE
Submission of an order does not necessarily mean that we have accepted the order.
We may cancel or decline an order where reasonably necessary, including because of product unavailability, payment problems, suspected fraud, incorrect pricing, technical errors, supplier availability, shipping restrictions, or other legitimate reasons.
If we cancel an order after payment has been successfully collected and no goods are supplied, the applicable payment will be refunded.
7. ORDER CANCELLATIONS
Customer cancellation requests must be submitted within 1 hour of placing the order.
After the 1-hour cancellation period has expired, orders cannot be cancelled except where required by applicable law.
This provision does not restrict mandatory cancellation or withdrawal rights available under applicable consumer-protection law, including applicable rights of European Union consumers.
8. RETURNS AND REFUNDS
Except where required by applicable law, all sales are final.
We do not accept returns, exchanges, or provide refunds for change of mind, incorrect sizing selections, unwanted products, personal preference, or dissatisfaction with an eligible mystery box selection.
Defective, damaged, or incorrectly supplied products will be handled according to our Return & Refund Policy and applicable law.
Our Return & Refund Policy forms part of these Terms.
9. SHIPPING AND DELIVERY
Shipping and delivery times displayed on our website are estimates and are not guaranteed unless expressly stated otherwise.
Delivery may be affected by carrier delays, customs processing, customs inspections, weather, holidays, high shipping volumes, supplier processing, logistical disruptions, international transportation, or other circumstances outside our reasonable control.
Except where required by applicable law, shipping delays alone do not entitle a customer to a refund, return, cancellation, credit, or compensation.
Orders may be delivered in multiple packages and on different dates.
A shipment that exceeds an estimated delivery date is not automatically considered lost. Confirmed lost or undelivered orders will be handled according to our Return & Refund Policy and applicable law.
10. SHIPPING INFORMATION
Customers are responsible for providing complete and accurate names, delivery addresses, apartment or unit numbers, postal codes, telephone numbers, and other information reasonably required for delivery.
We are not responsible for delays or failed delivery caused by incorrect or incomplete information provided by the customer, except where applicable law provides otherwise.
Customers should contact us as soon as possible after discovering an address error. We cannot guarantee that shipping information can be changed once fulfillment has begun.
11. CUSTOMS, DUTIES AND IMPORT TAXES
International orders may be subject to customs duties, import taxes, VAT, brokerage fees, handling fees, or other charges imposed by the destination country, customs authority, carrier, or other applicable authority.
Unless these charges are expressly stated as included or collected at checkout, the customer is responsible for applicable customs duties, import taxes, brokerage fees, and other import-related charges imposed on the shipment, to the extent permitted by applicable law.
SKI SUPPLY does not control charges imposed independently by customs authorities or shipping carriers.
Customers are responsible for understanding import requirements applicable to their destination. Refusal to pay an applicable import charge does not automatically create a right to a refund, except where required by applicable law.
12. EUROPEAN UNION CUSTOMERS
Consumers located in the European Union may have mandatory consumer rights, including a statutory right to withdraw from certain eligible distance purchases.
Where applicable, eligible EU consumers generally have 14 days after receiving the goods to exercise their right of withdrawal, subject to applicable exceptions.
The customer is responsible for the direct cost of returning goods when permitted by applicable law and when properly disclosed.

Nothing in these Terms is intended to waive, restrict, or exclude consumer rights that cannot legally be waived or excluded.
13. PROMOTIONS AND DISCOUNT CODES
Promotions, discount codes, special offers, and sales may be subject to additional conditions.
Unless expressly stated otherwise, discounts cannot be combined. We reserve the right to modify or discontinue promotions and to reject unauthorized, fraudulent, duplicated, or improperly obtained discount codes, subject to applicable law.
14. INTELLECTUAL PROPERTY
Unless otherwise stated, content created for the SKI SUPPLY website, including our branding, logos, graphics, website design, written content, and original materials, is owned by or licensed to SKI SUPPLY and is protected by applicable intellectual-property laws.
You may not reproduce, distribute, commercially exploit, or use our protected content without authorization, except where permitted by law.
Third-party trademarks, product names, images, and other intellectual property remain the property of their respective owners.
15. PROHIBITED USES
You may not use our website to engage in fraudulent activity, interfere with website security, introduce malicious code, scrape or collect information unlawfully, impersonate another person, attempt unauthorized access to systems, abuse promotions, or engage in conduct prohibited by applicable law.
We may restrict access to our services where reasonably necessary to protect SKI SUPPLY, our customers, our service providers, or others.
16. THIRD-PARTY SERVICES
Our website may rely on third-party services, including Shopify, payment processors, fulfillment providers, suppliers, analytics providers, and shipping carriers.
Certain third-party services may be governed by their own terms and privacy policies.
SKI SUPPLY is not responsible for independent third-party websites or services outside our control, except to the extent responsibility cannot legally be excluded.
17. PERSONAL INFORMATION
Personal information submitted through our store is handled according to our Privacy Policy and applicable privacy laws.
Payment information may be processed by Shopify or other authorized payment processors rather than directly by SKI SUPPLY.
18. DISCLAIMER AND LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, SKI SUPPLY will not be liable for indirect, incidental, special, consequential, or similar damages arising from use of our website or products where such liability may legally be excluded.
Nothing in these Terms excludes or limits liability, warranties, guarantees, remedies, or consumer rights that cannot legally be excluded or limited.
19. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold SKI SUPPLY harmless from claims, losses, liabilities, and reasonable expenses resulting from your unlawful use of our website, your violation of these Terms, or your infringement of another person’s rights.
20. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or severed where appropriate, and the remaining provisions will continue in effect.
21. CHANGES TO THESE TERMS
We may update these Terms from time to time. The current version will be posted on this page with an updated “Last Updated” date.
Changes will apply prospectively to the extent required by applicable law and will not eliminate rights that customers acquired under applicable law or agreed terms before the change.
22. GOVERNING LAW
These Terms are governed by the applicable laws of Ontario, Canada, and the federal laws of Canada applicable therein, without limiting any mandatory consumer protections or jurisdictional rights that apply to customers in their place of residence.
